“OLD TOWN ROAD” – LESSONS TO COPYRIGHT?
PANEL THEME:
“Old Town Road” is a song that has become a blockbuster hit and sucessfull in international critic opinion, breaking the “weeks on top” record of “Billboard Hot 100”, the #1 US hit. However this song has a “secret”: It was built primarily from the success of user-generated content based on pre-existing works, and made famous by the Chinese platform TikTok, which publishes such content in short videos. This case serves as a basis for discussion in Europe and around the world the responsibility of content providers, including about art. 17 of the Digital Single Market Copyright Directive, but it still involves rethinking several concepts in the way we view copyright today.

CASE STUDY: COPYRIGHT IN THE EUROPEAN DIGITAL SINGLE MARKET
The European Digital Single Market Copyright Directive (2016/0280) was recently approved within the European Union. Its legislative process was mainly marked by the debate about the benefits and harms of the former Articles 11 and 13, which after the reformulation of the text became Articles 15 and 17. But the normative brings other relevant topics that go far beyond these articles. What are, after all, the real changes in European copyright and their impacts on the rest of the world that jurists and artists will have to take into account in the years to come?

At the THIRTEENTH EDITION OF CODAIP (Congress of Copyright and Public Interest), on November 4th, 2019, in Curitiba, the Copyright and Industrial Property Study Group (GEDAI-UFPR) will promote WORKSHOPS ON INTELLECTUAL PROPERTY LAW concerning relevant and modern topics.
The workshops will be eminently focused on providing practical learning through the application of the theoretical knowledge acquired during the exhibitions.
During the workshop, participants are provided with individual copies of the material, enabling the practical analysis of the cases addressed.
By the end, a publication of all material will be produced in both digital and printed media. All pictures of the workshops will be published on the website www.gedai.com.br

The protection of intellectual property operates under domestic law and international law. Globalization promoted by the information society has gradually increased the relevance of this latter category of norms. As a result of the expansion of globalized markets connected by new technologies, international trademark registration becomes more relevant. PDL 98/2019 formalizes Brazil’s accession to the Madrid Protocol, with the aim of reducing bureaucracy. The Madrid System enables companies and individuals in a member country to apply, through the World Intellectual Property Organization, for the registration of a mark already applied for or registered in their home country. But, given the various structural and procedural transformations that will be imposed on this new reality, it is necessary to consider the effects of this system applied to Brazil and the development of Brazilian companies. What will be the benefits and which points require more caution?

The public interest guides all public policy agendas linked to intellectual rights that involve the diffusion of culture, knowledge and information. The search for balance between public and private is a constant without easy answers. The informational society and the recent new technologies make this process even more complex, affecting basic concepts such as the idea of originality. The final panel of CODAIP keeps alive this continuous debate about the past, present and future of the convergence between technology and intellectual law, focusing on copyright. What would be the precautions and parameters for legislative and jurisprudential changes? How to develop a purposeful agenda? Does intellectual property, as a legal branch, tend to weaken or strengthen in the coming years?
